Terms of Service

11. Parties and Acceptance

These Terms apply to your use of the letsmark.app site, app and Discord bot (the "Service"). The Service is run by an individual, not a company ("we"). By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.

22. Your Account

• You must be at least 16 to create an account.
• You must give a valid email address of your own. Your account is personal; you may not transfer, sell or share it.
• You are responsible for keeping your password and account secure. Tell us straight away if you notice unauthorised use.
• If your account has been permanently banned, you may not create a new one.

33. The Service

The core Service is free and provided "as is". Some extra features are available through an optional paid subscription, described in the next section. We may change or restrict features, or end the Service altogether. Before ending it we give reasonable notice and a chance to export your data; if you have a subscription, we stop it renewing and refund the unused part of a period you have paid for.

Information and images for films, shows, anime and books come from third-party sources such as TMDB, TheTVDB, AniList, Google Books and Open Library, and we do not guarantee their accuracy. This product uses the TMDB API but is not endorsed or certified by TMDB. Let's Mark is not affiliated with IMDb, Netflix, TMDB or the owners of any title.

44. Premium Subscription

• Premium is an optional monthly subscription that unlocks extra profile features. The current price and features are on the Pricing page. Everything else in the Service stays free.
• Payments are handled by Polar (polar.sh), which acts as the merchant of record: it sells you the subscription, takes the payment, charges any applicable tax and issues the receipt. Polar's terms also apply to the purchase.
• The subscription renews automatically every month until you cancel it. You can cancel at any time from Account settings; you keep Premium until the end of the period you have paid for, and no further payment is taken.
• When Premium ends, the extras you set up are hidden, not deleted. They come back if you subscribe again.
• If your account is suspended or banned, we stop the subscription renewing; if that is not possible, we end it straight away. Deleting your account ends the subscription immediately.
• Right of withdrawal: you may withdraw from the subscription within 14 days of your first payment, without giving a reason, by writing to legal@letsmark.app. We then end Premium and refund that payment in full, through Polar, within 14 days of your message. Premium starts as soon as you pay, and in some countries the law would therefore let the seller keep part of the payment or exclude withdrawal altogether; we do not rely on that.
• Monthly renewals after the first payment are not refunded, but you can cancel at any time so that the next one is not taken. If a payment was taken in error, such as a double charge or a charge after you cancelled, write to us and we refund it.
• Nothing in this section limits a right that consumer law in your country gives you.
• We may change the price or the features included. A price change applies from your next renewal, and we announce it by email at least 15 days before; you can cancel before it takes effect.

55. Your Content

You keep the rights to the comments, lists, scores, notes, images and audio you add to the Service. When you share them, you grant us a worldwide, free, non-exclusive licence, covering the rights of reproduction, adaptation and communication to the public, to host and display that content on the Service and adapt it as the Service needs (for example, resizing an image). The licence ends when you delete the content or your account.

You are responsible for what you share, and you confirm you hold the rights needed for it. In particular, you may upload as a profile song only audio you have the right to share. We are not required to review content before users share it.

66. What You May Not Do

When using the Service you may not:

• Share unlawful, defamatory, threatening, harassing, hateful or obscene content, or content that encourages violence
• Share content that infringes someone else's copyright, trademark or personality rights
• Share other people's personal data without permission
• Post spam, advertising or misleading content, or impersonate someone
• Leave a comment containing spoilers unmarked as a spoiler
• Try to gain unauthorised access to the Service, other accounts or systems, or get around security measures
• Collect data without permission or disrupt the Service using bots, scrapers or other automated tools

77. Moderation and Account Termination

We may remove content that breaks these Terms or the law, after a report or on our own initiative, and we may restrict your commenting, suspend your account or close it. If the number of your removed comments passes set thresholds, commenting is restricted automatically. You can appeal a decision by writing to legal@letsmark.app.

You can delete your account at any time from Account settings. Accounts nobody has signed into for more than 180 days may be deleted as described in the Privacy Policy; this does not happen while you have an active subscription.

88. Intellectual Property

The Let's Mark name, logo, design and software belong to us and may not be copied or used commercially without permission. Names, posters and images of titles belong to their owners. If you see content that infringes your rights, follow the steps on the Copyright Notice page.

99. Limitation of Liability

We do not guarantee that the Service will be uninterrupted or error-free, or that your data will never be lost. To the extent the law allows, we are not liable for indirect damage or data loss arising from use of, or inability to use, the Service, for content shared by users, or for third-party services (Google, Discord, content sources). This limitation does not apply to damage caused by our intent or gross negligence, or to liability that cannot be limited by law.

You agree to cover damage arising from claims brought against us by third parties because you broke these Terms.

1010. Changes

We may update these Terms. We give notice of significant changes at least 15 days before they take effect, on the site or by email. If you keep using the Service after a change, you accept the new Terms. If you do not accept them, you can delete your account.

If a translation of these Terms differs from the English version, the English version prevails.
